GENERAL CONDITIONS OF SALE

IF YOU BUY A DIGITAL DOWNLOAD PRODUCT, PLEASE CAREFULLY READ THE TERMS & CONDITIONS OF SALE FOR THESE PRODUCTS: ARTICLE 6

Article 1. Scope of Application and Amendments to the General Terms and Conditions of Sale:

These terms and conditions of sale apply to all orders received via the Internet site http://Shop.ubi.com/
Ubi.com reserves the right to adapt or amend these General Terms and Conditions of Sale at any time. If these Terms and Conditions are amended, each order shall be governed by the General Terms and Conditions of Sale in effect on the date of the order.

Article 2. Availability of Products:

- Our product offers and prices are valid as long as they are displayed on the site, within the limits of available inventories.

- You will be informed in real time of the products that are available in inventory.
If a product is unavailable, the date the product is expected to be back in stock will be clearly indicated in the product description.
We promise to confirm your order or to ship the product you ordered within six weeks or to refund your money by bank transfer.

The order confirmation date is:
- The date of the order, if payment is by bank card on line.
- The date the bank transfer is received, if payment is by bank transfer.
- The date the charge is collected, if payment is made by direct debit to your bank account.

- If one of the products in your order is out of stock:
we will ship the other parts of your order, accompanied by a notification of the status of the remaining items you ordered.

- Pre-ordered items:
The official release date is displayed on the product description posted on the site.
You can place an advance order for your product in the form of a pre-order.
You can rest assured that we will ship your product as soon as it is released.
Please note that Ubisoft may change the official release date at any time.

Article 3. Confirmation of Orders and Electronic Signature

The order form “signed” with a double-click by the customer constitutes an irrevocable agreement to purchase, which may be retracted only under the conditions stipulated in these General Terms and Conditions of Sale, e.g. if the order is retracted under the proper conditions or if the item is out of stock.

The double-click that is part of the order authentication and confirmation procedure also protects the integrity of your communications with us and constitutes an electronic signature. This electronic signature has the same value as a handwritten signature in the relationship between the parties.

Article 4: Price

Ubi.com reserves the right to revise its prices at any time, but promises to charge you the prices that are indicated to you when you place your order, subject to availability on the date you place your order.

Article 5: Payment Procedures and Secure Payments:

- Payment Procedures: You can make payment using one of the methods described below:

- Bank card: Payment by bank card is made on our service-provider BIBIT’s totally secure site. Your banking information is encrypted and will not be stored on Ubi.com’s servers. Payment by bank card is therefore totally secure. Your order will be recorded and confirmed as soon as your payment is accepted.
For your added protection and to guard against any potential fraud, Ubi.com may ask you to send a copy of your identification card and/or a statement of bank account information (IBAN) by e-mail, fax or mail.
You can pay on line with full confidence by entering the number and expiration date of your bank card in the fields provided for the purpose.

- Bank transfer: The order will be processed only when the transfer is received in Ubi.com’s account. In no case will the product you have selected be reserved for you.

- Direct debit to your bank account: The order will be processed only when the amount debited is received in Ubi.com’s account. In no case will the product you selected be reserved for you.

- Security:

Your credit card information is encrypted using the SSL (Secure Socket Layer) protocol and is never transmitted over the network in clear text. Payment is made directly to a bank. In no case does Ubi.com have access to this information, nor does Ubi.com store the information on its servers. That is why you will be asked to re-enter this information every time you place an order on our site.

- Reservation of Title:

Ubi.com retains title to the products until the full purchase price has been received by Ubi.com.

- Non-payment:

Ubi.com reserves the right to refuse to make shipment or to honor an order issued by a customer who has not paid in full for a previous order or with whom a payment dispute is outstanding.

- Fraud-prevention Measures:

To protect you and to prevent potential fraud, Ubi.com may ask you to send a copy of your identification card and/or Statement of Bank Account Information (IBAN) by e-mail, fax or mail.
In the context of these procedures, our company may also ask you for all documents necessary to approve your order: proof of residence, bank statements etc..

Article 6: Digital Download Products

6.1. Order processing
After having acknowledged receipt, Ubisoft will process your order as soon as your payment is accepted and will send your serial key for the game to your online client account and by email.

6.2. Withdrawal
The operation of downloading a product to your computer using the key sent to you constitutes both the start of performance and the act of unsealing a product.
Consequently, no right of withdrawal may be exercised for these products.
The download data relating to the serial key for the game posted on the Ubisoft server shall apply.

Article 7: Shipping Procedures

All information regarding our shipping policy can be found here.

If multiple shipments are necessary to fill a single order, the first shipment will be made by the delivery method selected. Subsequent shipments will be free and will be sent by mail in the form of a tracked parcel.
Ubi.com cannot be held liable for any consequences of late delivery by the Post Office, Chronopost or a carrier.
The only shipping method that can be used for shipments outside Europe is “Express”. The list of countries considered within Europe is clearly indicated on the site in the description of the different shipping methods.

General Information:

Products purchased in the Ubisoft online store (http://Shop.ubi.com/) can be shipped anywhere in the world.
Depending on the country to which the products are being shipped, local taxes on the total amount of your order may apply. Additional information is available from the customs service of the country of destination.
The products are shipped to the shipping address you give us during the order process. The delivery times indicated are average times and reflect the time required for processing, preparing and transporting your order. For items that are to be delivered on different dates depending on their availability, the delivery time for all the products ordered is based on the longest shipping time. Ubi.com reserves the right to ship parts of an order individually.

Shipping times:

Shipping times are indicated when you select the shipping method.
The times indicated are average times depending on the destination, the shipping method and the availability of the item.
Ubi.com cannot be held liable for the consequences of late delivery by the Post Office, Chronopost or a carrier.

All orders received on the Internet site (http://Shop.ubi.com/) will be shipped Monday through Friday - excluding holidays.

Tracking your shipment:

Once you have selected and confirmed your method of payment, you will be assigned an Order Number. Please print out the order confirmation and keep it in a safe place. The Order Number indicates that your order has been recorded.
You may check your order status at any time by visiting the “My Account” section, which is accessible directly from the Ubisoft Online Store home page (http://Shop.ubi.com/), and entering your account name and password.

Article 8: Liability

- Ubi.com cannot be held liable for breach of contract in cases of force majeure, acts of God, labor unrest or total or partial strikes, specifically of the postal services and carrier and/or communications services, flood or fire. With regard to products that are purchased for business use, Ubi.com cannot be held liable for any indirect damages, including damages for disruption of operations, lost profit, injury or expenses that may result from this transaction.


- The customer is solely and exclusively liable for the selection and purchase or a product or service. Any inability on the part of a customer to use some or all of the products on account of hardware incompatibility shall not be grounds for damages, refund or any liability on the part of Ubi.com.

- If all or part of an order is not delivered, you have a maximum period of 1 (one) year (counting from the date the product leaves our warehouse) to register your claim. We will not accept any claims after said period has expired.


Article 9: Right of Retraction:

The customer has a period of 7 business days after delivery of an order to return any items that are unwanted and to request a replacement or refund without penalty, although the customer is required to pay the return shipping charges.

Before returning your product to us, make certain you have your Return Authorization Number (See “Return Procedure” below). The product must be returned unused and in its unopened original packaging (with the product seal still in place)..

Return procedure

- You have a period of 7 days after receipt to notify our Customer Service Department that you wish to return the product if you no longer want the product or is not what you ordered.
- To make a return, you must first contact our Customer Service Department to request a Return Authorization Number. (To obtain a Return Authorization Number, click on the “My Account” section, which will ask you to identify yourself by entering your account name and password.)
- We will not accept any returns without a Return Authorization Number, and the items will be automatically returned to you.
- You must pay the costs of return shipping.
- Returned products can be accepted only if the products are complete and in their unopened original packaging with a copy of the purchase invoice. Articles that are returned incomplete, used, damaged or removed from their packaging by the Customer will not be accepted.
- We promise to send you a replacement, a credit or a refund within a maximum of 30 days after we receive the products.
- COD shipments will not be made under any circumstances.

Article 10: Warranties and Customer Service:

Products purchased from the Ubisoft on-line store (http://Shop.ubi.com/) come with a 90 to 180-day warranty. See the product literature for additional information.
All our products are covered by a Ubisoft warranty.
If a product sold by Ubisoft proves defective within the initial warranty period, it will be replaced by Ubisoft Customer Service free of charge.
Before you return a product to Ubisoft Customer Service, you must first ask us for a Return Authorization Number. To obtain a Return Number, please visit the “My Account” section of our Internet site and enter your account name and password.

Please keep the invoice for your purchase, which will be required to file warranty claims.

Article 11: Data Protection:

You have the right to “consult, change, correct and delete your personal information” at any time (within the meaning of Article 34 of the French Data Protection Act – “Informatiques et Libertés” - of January 6, 1978).
